The Agent’s Guide to Life Insurance Underwriting for Zyn, Vaping, and Smokeless Tobacco
Stop letting a nicotine pouch kill your commissions. Here is how to secure Non-Smoker rates for clients who use modern nicotine.
It is one of the most frustrating ways to lose a massive life insurance case.
You ask your healthy, 35-year-old client if they smoke. They honestly answer, “No.” You quote them a Preferred Best Non-Smoker rate, submit the application, and schedule the paramedical exam.
A week later, the underwriter calls. The client’s lab results flagged positive for nicotine. The carrier immediately slaps the policy with a “Standard Tobacco” rating, the premium triples, the client is furious, and the deal falls apart.
What happened? The client doesn’t smoke cigarettes, but they pop Zyn pouches at their desk all day.
For decades, the life insurance industry operated on a binary rule: Any nicotine in the system = Smoker Rate. Today, that rule is obsolete. With the explosion of Zyn, vaping, and nicotine gums, a few highly progressive life insurance carriers have completely rewritten their guidelines.
If you know where to look, you can actually secure Non-Smoker (and even Preferred Non-Smoker) rates for clients who use smokeless nicotine. Here is exactly how underwriters view these products today.
The Science: The “Cotinine” Trap
First, agents must understand what the carrier is actually testing for. The paramedical blood and urine test does not look for tobacco; it looks for cotinine, an alkaloid found in tobacco and the primary metabolite of nicotine.
Cotinine stays in the bloodstream and urine much longer than nicotine itself (often up to 10 days). If your client uses a Zyn pouch, chews nicotine gum, or vapes, they will test positive for cotinine. If you submit them to a rigid, old-school carrier, that positive test means an automatic Tobacco rate.
How Top Carriers Grade Modern Nicotine Products
1. Zyn and Nicotine Pouches These are the fastest-growing nicotine products on the market. Because they contain zero tobacco leaf and require no combustion (smoking), progressive carriers view them highly favorably.
-
The Good News: Several top-tier carriers will offer Non-Smoker, Preferred, and even Preferred Best rates to clients who use nicotine pouches—if it is disclosed upfront on the application.
2. Chewing Tobacco, Snuff, and Snus Similar to nicotine pouches, the lack of inhalation drastically reduces the respiratory and lung-cancer risks associated with cigarettes.
-
The Good News: You do not have to settle for Tobacco rates here. Many major carriers (like Prudential and Lincoln, historically) will offer Non-Smoker rates for chewing tobacco users, provided their overall health and oral hygiene exams are clean.
3. Vaping and E-Cigarettes This is the trickiest category. Despite the claims that vaping is “healthier” than smoking, the life insurance industry largely disagrees. Because vaping involves inhaling heated chemicals and vapor into the lungs, the long-term respiratory data is still too murky for underwriters to ignore.
-
The Reality: The vast majority of carriers will automatically rate vapers as Smokers.
-
The Exception: If your client quit vaping, most carriers require them to be completely nicotine/vape-free for 12 to 24 months before they can qualify for Non-Smoker rates again.
4. The Occasional Cigar A classic staple of high-net-worth underwriting. If your client smokes a cigar on the golf course or to celebrate a closed deal, they do not have to pay Smoker rates.
-
The Rule: Most carriers allow between 12 to 24 cigars per year and will still grant a Preferred Best Non-Smoker rate. However, the client’s urine test must still come back negative for cotinine, and the cigar use MUST be admitted on the initial application.
The Fatal Mistake: Non-Disclosure
The absolute worst advice an agent can give a client is: “Just don’t mention the Zyn on the application.”
If a client claims zero nicotine use on the app, but pops positive for cotinine on the lab exam, the underwriter assumes they are a cigarette smoker who lied. The carrier will immediately decline the application for misrepresentation, and that decline gets recorded in the MIB (Medical Information Bureau), damaging the client’s ability to get insurance elsewhere.
Disclosure is your ultimate weapon. If you admit the smokeless nicotine use upfront in a cover letter, the underwriter will process it according to their smokeless guidelines rather than flagging it as a lie.
Your Field Underwriting Checklist
Before you hit “submit” on an e-App, ask your client these four exact questions:
-
Do you use ANY form of nicotine? (Specifically name drop Zyn, vaping, gum, and cigars).
-
How often do you use it? (Daily, weekly, or just a few times a year?)
-
When was the exact date you last used it?
-
Have you ever smoked traditional cigarettes? (If yes, what date did you quit?)
Stop Guessing. Let Us Pre-Screen the Case.
You do not have the time to memorize which of the top 20 carriers is friendly to Zyn and which one will penalize it.
That is what our back-office support is for. If you are doing a fact-finder with a client who uses any form of smokeless nicotine or vapes, do not submit a formal application.
Send our brokerage team a quick email with the answers to the checklist above. We will run an anonymous pre-screen with our underwriting desk, match your client to the most lenient carrier, and help you lock in a Non-Smoker rate so you can save the case and protect your commission.
